Of when this document enters into force
This section establishes the regime of entry into force of the constitutional document. The currently published version corresponds to editorial draft 0.2, prepared by the founding team in Lima, May 2026. The definitive ratification of the document requires the procedure described in this section.
Editorial draft 0.2 produces operational effect over Alerta from its publication. The tricameral ratification confers on the document a formal constitutional character and activates the procedures described in articles IV, XII and XIV.
On the character of the editorial draft
Editorial draft 0.2 expresses the institutional will of the founding team regarding the architecture that Alerta will adopt. The publication of the draft permits open civic consultation, the incorporation of observations from the first Vigías, and the public deliberation of the chambers before their formal constitution.
The editorial draft governs the operation of the system during Phase 1A (closed beta) and Phase 1B (founding circle). Its modification during this period requires agreement of the founding team and prior public consultation with a minimum of two weeks of advance notice. The modifications are announced in the public registry of amendments.
On the ratification procedure
The ratification of the document requires the concurrence of the three chambers constituted in accordance with Article IV. The concurrence requires:
- Simple majority in the Chamber of Vigías.
- Simple majority in the Editorial Chamber.
- Qualified majority of two thirds in the Chamber of Custody.
The qualified majority in the Chamber of Custody reflects the fiduciary nature of the chamber with respect to the inalienable corpus of Article II. Its pronouncement ratifies that the document is compatible with the regime of the corpus and with the institutional duration committed.
The chambers are constituted during Phase 1B of the launch calendar. The ratification is scheduled for the ninety days following the constitution of the third chamber. The term permits the paused reading of the document, the internal deliberation of each chamber, and the negotiation of pre-ratification amendments when any chamber requires them.
On the entry into force of the ratified document
The ratified document enters into force the first Monday following the tricameral concurrence. The entry into force activates:
- The full application of the modification regime of Article IV.
- The quarterly publication of financial transparency in accordance with Article XII.
- The annual external audit of the algorithmic constellation in accordance with Article XII.
- The activation of the counter-observation procedure of Article XI for cases subsequent to ratification.
- The retroactive application of the civic safety regime of Article V to all active files.
The observations documented during the editorial draft period retain full validity after ratification. The commitments assumed with Aliados, Experts and Vigías during the draft period continue operating under the ratified regime.
On modifications subsequent to ratification
Modifications of the document subsequent to ratification are carried out exclusively by the procedure of Article IV. The founding team loses, with ratification, the faculty to unilaterally modify the document. Its voice is incorporated into the deliberation of the chambers in the terms that each chamber establishes.
The ratified modifications are recorded in the public registry of amendments with their date of entry into force, the modified text, the resulting text, and the vote of each chamber.
On the signature of the document
Editorial draft 0.2 carries the signature of the founding team in its published version. The signature remains visible after ratification alongside the signature of each chamber on the date of its pronouncement. The superposition of signatures permits the reconstruction of the institutional history of the document without replacing the origin of the text.
The editorial signature responsible for editorial draft 0.2 corresponds to Maxime Nassour, founder of Alerta and representative of the founding team. The signature of the chambers will be documented in due course with the names of those who compose them.
